STANDARD TERMS AND CONDITIONS OF SALE

1. ACCEPTANCE OF TERMS
By placing an order, requesting a quote, making a purchase, or using this website, the customer agrees to be bound by these Terms and Conditions.
Any terms proposed by the customer that conflict with these Terms and Conditions shall not apply unless expressly agreed to in writing by D. Millz 3D Works.
2. ORDERS AND QUOTATIONS
All quotations are valid for thirty (30) days unless otherwise stated.
Orders are subject to acceptance and product availability.
D. Millz 3D Works reserves the right to refuse any order at its sole discretion.
Custom orders may require approval of artwork, designs, specifications, or proofs before production begins.
3. PRICING
All prices are subject to change without notice.
Shipping charges, taxes, setup fees, artwork fees, and other applicable charges may be added at checkout or included in written quotations.
Pricing errors may be corrected at any time prior to shipment.
4. PAYMENT TERMS
Retail orders are generally due at the time of purchase.
Business, organizational, or approved account customers may be offered invoice terms at the discretion of D. Millz 3D Works.
Invoices are due according to the payment terms stated on the invoice.
Late payments may be subject to service charges, interest, collection costs, attorney fees, and other expenses permitted by law.
D. Millz 3D Works reserves the right to suspend production, shipment, or future services for overdue accounts.
5. CUSTOM PRODUCTS
Due to the personalized nature of custom products, customers are responsible for reviewing all submitted information and approving artwork, spelling, dates, names, colors, and layouts prior to production.
Once production has begun, changes may not be possible.
D. Millz 3D Works shall not be responsible for customer-approved errors.
6. CUSTOMER SUPPLIED ARTWORK
By submitting artwork, logos, photographs, graphics, trademarks, or other content, the customer represents and warrants that they possess all necessary rights, permissions, licenses, and authorizations for reproduction.
Customers represent and warrant that they own the submitted content or possess all necessary permissions to use it. Customers further represent that the submitted content does not violate any copyright, trademark, privacy, publicity, or other intellectual property rights. Customers assume full responsibility for all submitted content.
D. Millz 3D Works reserves the right to refuse any order that may infringe upon intellectual property rights or violate applicable laws.
Customers agree to indemnify and hold harmless D. Millz 3D Works from any claims, damages, liabilities, costs, expenses, or legal fees arising from customer supplied content.
7. COPYRIGHT AND TRADEMARK POLICY
D. Millz 3D Works does not knowingly reproduce copyrighted, trademarked, or otherwise protected materials without authorization from the rights holder.
We reserve the right to request proof of ownership, licensing, or authorization before fulfilling any order containing logos, trademarks, copyrighted artwork, or other protected content.
We reserve the right to refuse any order that may violate copyright, trademark, or intellectual property laws.
8. PRODUCT VARIATIONS
Colors displayed on screens may vary from the final product.
Minor variations in color, placement, sizing, texture, or appearance shall not be considered defects.
Handmade and custom products may contain slight variations that are inherent to the production process.
9. PRODUCTION AND DELIVERY
Production times are estimates only and are not guaranteed.
D. Millz 3D Works shall not be liable for delays resulting from shipping carriers, weather conditions, supply shortages, equipment failures, customer approval delays, or other circumstances beyond our reasonable control.
10. SHIPPING AND RISK OF LOSS
Risk of loss transfers to the customer upon delivery of products to the shipping carrier.
Customers are responsible for providing accurate shipping information.
Additional shipping charges may apply for returned, redirected, or reshipped packages.
11. RETURNS AND REFUNDS
Custom and personalized products are generally non-returnable and non-refundable except in cases of manufacturing defects or production errors.
Claims regarding defects or incorrect orders must be reported within seven (7) days of delivery.
Photographic evidence may be required before replacements, refunds, or credits are issued.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law, D. Millz 3D Works shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of its products or services.
The maximum liability of D. Millz 3D Works shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.
13. INTELLECTUAL PROPERTY
All logos, branding, product photographs, website content, graphics, and original designs created by D. Millz 3D Works remain the property of D. Millz 3D Works unless otherwise agreed in writing.
14. GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Ohio.
Any dispute arising from these Terms and Conditions shall be resolved in a court of competent jurisdiction located within the State of Ohio.
